Every Georgian should listen to this interview & think long & hard about what Tom has to say the next time they go vote. People talked about Speaker Tom Murphy like a dog, but he did treat everybody with respect. It's certainly not that way now that the Republicans are in charge. Personally, I think it's time to clean out the entire Capitol.

I just met David for the first time, I was feeling pretty cynical about meeting another politician, but amazingly enough his visit gave me hope. Most all of what he said I agreed with, and most importantly where we didn't agree, we could still discuss our differences constructively.

Check him out on youtube to learn what I can't tell you!

i too am accused of child molestation in cobb county . i went through a very bitter divorce and my ex wife who vowed retribution against me . about a month after the divorce was final i found a card from a cobb county dfcs worker asking me to meet with her at an address in downtown marietta . when i complied with her request i was greeted by her and a cobb county detective . in the interview the detective told me that my wife's grandchild had accused me of touching her inappropriately . this never happened . i believe my wife engineered this whole nightmare . i was asked to take a lie detector test which i was told did not turn out in my favor . i was very nervous during the test . the test operator contributed greatly to this anxiety by asking me to confess . i told him i could not confess because nothing happened to confess to . 4 months later i had a warrant for my arrest . i spent 41 days in cobb county jail in the sexual offenders cell . many of the men i was in jail with told the same story . that is that the cases were not investigated properly . inmany cases the police took the word of the child only and obtained a warrant on that basis . in my case i can not remember a time that i was ever alone with the child . patrick head has built a reputation of having a 95 percent conviction rate . i expect to do anywhere from 5 to 20 years in prison for a crime i did not commit . after talking to many of the other prisoners that were there for the same charge i am convinced that many are innocent . the thing is that when the cases go to trial these men will be badgered and bullied by the da into taking a plea bargain . they are told that if they the case to a jury trial they will be given the maximum sentence . the popular plea agreement in these cases is 10 years to do 5 . that is 5 years served and 5 on probation . they must register as sex offenders for the rest of their life . many cannot afford a decent attorney son they have to settle for a curcuit defender . these cases must be defended by a qualified attorney that is experienced in child molestation cases . these kind of cases are devastating to the accused . many people are being railroaded into jail with very little concrete evidence .

Mr Smith,

I enjoy your blog. Thank you for your effort, and keep it up!

Re Jekyll:

Your statement above is premised on the notion that it is acceptable and "good" for the State to use taxmoney to purchase an asset and to control it in perpetuity, as long as the State manages the income produced by the asset in accordance with the highly subjective idea of what is best

"for the sole purpose of beautifying, improving, developing, enlarging, maintaining, administering, managing, and promoting Jekyll Island State Park at the lowest rates reasonable and possible for the benefit of the people of the State of Georgia"

I am sure that as an attorney you can appreciate the fact that the above passage is just about as clear as the Jekyll mud, and that no two persons will have the same interpretations of that sentence. Yet you presume to know what is "reasonable" and "beneficial" for everyone else in the State who has been forced through taxation into funding Jekyll. But your ideal utilizes force, which is the ultimate and defining tool of the State.

I believe that the most moral and efficient solution to the controversy over Jekyll would be through the simple excercise of freedom: Sell Jekyll. Sell it outright. Fee simple. Let it be at least subject to the same legal restrictions as any other piece of earth. Return the proceeds from the sale to the taxpayers from whence they were taken. (yes this has practical problems but they should be dealt with and overcome by the State) Only then will the property be put to its highest and best use. Only then will the property become less of a political football to be kicked about by State politicians. Only then will Jekyll truly be subject to the long term stewardship that comes with the real ownership of something.

The people do not own Jekyll Island, in my opinion. The State owns it. The State is not the same thing as "the people", it is a certain finite group of folks. The State is predominately a collection of persons that are only temporary owners of Jekyll- they have a shorter time horizon, one which is dictated by the election process. They must tend to make use of the resource "now" as opposed to later- because there may not be any "later", if one loses his power through the political process. This inevitably tends to result in short-sighted management, as opposed to the longer view that comes with real ownership.

Now the practical side of selling off Jekyll warrants a whole nother long discussion-- how much, how soon, what terms, etc etc.

Comments?

ps legal question: Why was a letter of condemnation used in the purchase of Jekyll by the State?

Your analysis is dead on correct, Now take a look at how the resident property owners and long time small business operators on the Island are being jerked around and about to be raped by the Perdue flunkys on the JIA. The Board is engaging in nothing less than economic terrorism regarding the leases. Despite the fact that the current leases cannot be unilaterally altered or modified, Chairman Krueger, Director Hooks and their minions continually refer to slowly ramping up the lease payments throwing around numbers that range from $3,000 a year to $30,000 a year. The vast majority of resident owners are retirees on fixed incomes that have dramatically eroded over the last year. Clearly the Board is illegally applying economic duress. Frank Mirasola
